These Terms & Conditions set out the basis on which NORTHGATE HOUSE RTM COMPANY LIMITED provides residential property management, maintenance coordination, contractor coordination, communal area management and related property administration services.

The relevant service, scope, information requirements and delivery arrangement are confirmed before agreed work starts.

About these terms

These terms establish the general framework for the services we provide.

These Terms & Conditions apply to services provided by NORTHGATE HOUSE RTM COMPANY LIMITED, company number 14950635, whose registered business address is Glendevon House Hawthorn Park, Coal Road, Leeds, England, LS14 1PQ.

They should be read together with the relevant service description, agreed scope, Service Delivery Policy, Service Cancellation Policy, Complaints Policy, Privacy Policy and Cookie Policy where applicable.

If a specific written agreement for a particular property or service contains terms that differ from these general terms, the specific written agreement will apply to the extent of the difference.

Formation of an agreement

A service arrangement is established when the relevant scope and essential terms have been agreed.

Our services are focused on residential property management and practical coordination of building-related matters.

Residential Building Management Review

Review of relevant property information, management arrangements, maintenance matters, communal areas and related day-to-day requirements.

Maintenance Coordination

Review and organisation of maintenance matters, relevant communications, contractor contact and agreed follow-up.

Contractor Coordination

Communication and coordination relating to agreed contractor requirements, access information and relevant follow-up.

Communal Area Management Review

Review of shared entrances, corridors, facilities, external areas and relevant maintenance requirements.

Building Maintenance Action Plan

Organisation of available maintenance information into relevant actions, information requirements and follow-up points.

Property Management Administration Support

Organisation of property information, correspondence, maintenance records, contractor communications and agreed administrative tasks.

Scope of the service

The agreed scope determines what is included in a particular service.

The scope may identify the property or development concerned, the specific service required, the information to be reviewed, the actions to be taken, the expected output and the relevant delivery timeframe.

Work outside the agreed scope will not automatically be treated as included. Where an additional requirement is identified, the additional work will be explained before it is undertaken.

The website service descriptions provide general information about available services. The scope agreed for an individual matter determines the precise work to be undertaken.

Information provided by the client

Property management work depends on accurate and sufficiently detailed information being available.

Accurate information

Clients should provide information that is accurate and relevant to the agreed property matter.

Relevant documents

Where documents, correspondence, maintenance records or other information are required, they should be supplied in a reasonably usable form.

Access arrangements

Where access to a property is required for an agreed activity, appropriate access arrangements should be made by the person responsible for providing them.

Missing information

If necessary information or access is unavailable, the affected part of the service may need to remain pending until the relevant information or arrangement is available.

Service delivery

Services are delivered according to the agreed scope and the information available for the particular matter.

We will carry out agreed services with reasonable care and skill and in accordance with the service arrangement applicable to the work.

Typical service timeframes are stated in the relevant service description. They are estimates based on the circumstances normally associated with the service and may be affected by information requirements, property access, contractor availability or responses from other parties.

Where a relevant delay becomes apparent, we aim to provide appropriate information about the position and next step.

Completion of a service means that the agreed service output or action has been provided within the scope confirmed for that matter. It does not mean that an independent contractor or third party has completed work that is outside our control.

Third-party involvement

Where a service involves contractors, suppliers, property representatives or other third parties, we coordinate the relevant activity within the agreed scope but do not control the independent performance, availability or contractual obligations of those third parties.

Changes to an agreed service

Property matters can change after work has started.

If the requirement changes, we will consider whether the revised request remains within the existing scope.

Where it remains within scope, the delivery arrangement may be adjusted to reflect the revised requirement.

Where the request is outside the agreed scope, the additional work and any resulting change to the expected timeframe will be explained before the additional work begins.

A request to alter an existing service does not automatically constitute a cancellation of the original arrangement.

Cancellation

Cancellation is handled according to the applicable contract and any statutory cancellation rights.

Consumer cancellation rights

Where the applicable consumer cancellation rules apply to a distance or off-premises service contract, the statutory cancellation period is generally 14 days from the day the contract is entered into.

Starting during the cancellation period

A service will only be started during an applicable statutory cancellation period where the relevant legal requirements for an express early-start request have been satisfied.

Work already supplied

Where a consumer validly cancels after expressly requesting early performance, an applicable proportionate amount may be payable for service supplied before cancellation, subject to the statutory rules.

Business arrangements

Where the client is acting in the course of a business or other organisational activity, cancellation is normally governed by the agreed service arrangement and applicable law.

Responsibility and liability

Responsibility is considered according to the agreed service, applicable law and the circumstances of the matter.

Our responsibility

We are responsible for carrying out the services we have agreed to provide in accordance with the applicable contractual terms and applicable legal requirements.

Information supplied by others

Where decisions or actions depend on information supplied by a client, contractor or another party, the accuracy and completeness of that information may affect the service.

C

Independent contractors

Contractors and other third parties may have their own contractual responsibilities. Their work, availability, attendance and response remain subject to their own arrangements.

D

Statutory rights

Nothing in these terms excludes or restricts any liability or statutory right that cannot lawfully be excluded or restricted.

E

Reasonable limitations

Where the law permits contractual limitations of liability, any such limitation will be interpreted and applied only to the extent permitted by applicable law and subject to any applicable reasonableness requirements.

Important

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded or limited.

Information and privacy

Information provided in connection with a property management service is handled according to the applicable privacy requirements.

Information may be used where reasonably required to respond to an enquiry, organise an agreed service, communicate about a property matter, maintain relevant records or meet applicable legal and administrative requirements.

Personal information is handled in accordance with our Privacy Policy .

Complaints

If you are dissatisfied with an agreed service, we encourage you to raise the matter so that it can be reviewed.

Complaints should preferably be made in writing and should identify the relevant property, service and nature of the concern.

We aim to acknowledge written complaints within 3 working days and provide a substantive response to straightforward matters within 10 working days.

Where a complaint requires information from contractors, property records or other parties, additional time may reasonably be required. In such cases, an appropriate progress update will be provided.

Governing law

The contractual relationship is governed by the law applicable to the relevant agreement and the parties.

These Terms & Conditions and any service agreement formed under them are governed by the law of England and Wales, unless mandatory legal requirements provide otherwise.

Where a consumer has rights under mandatory consumer protection legislation, those rights remain unaffected by this governing-law provision.

Any dispute will be dealt with by the courts having appropriate jurisdiction, subject to any mandatory rights or jurisdictional protections that apply to the relevant client.
